1. DEFINITIONS
1.1. Seller - SE “Registrų centras” of the Republic of Lithuania, private legal entity MB “EasyGetWarm” registered in the Vilnius branch of the Register of Legal Entities, legal entity code 305578192, VAT payer code LT100013222512, registered office address Rato str. 22, Diržioniškės, LT-19154 Širvintų r., Correspondence address Rato str. 22, Diržioniškės, LT-19154 Širvintų r.
1.2. easygetwarm.com - e-shop (hereinafter - easygetwarm.com) at www.easygetwarm.com
1.3. Buyer - 1) an active natural person, i.e. a person who has reached the age of majority and whose capacity is not restricted by court order; 2) a minor between the ages of fourteen and eighteen who has the consent of his or her parents or guardians, unless he or she is emancipated; 3) a legal person; 4) duly authorized representatives of all the above persons.
1.4. Parties - Buyer and Seller together.
1.5. Seller's partner - legal entity:
1) selling goods or providing services to easygetwarm.com, as well as a legal entity used to fulfill the Buyer's order;
2) the joint promotions or projects with which easygetwarm.com is carried out are published on the websites of this legal entity or in any media in which easygetwarm.com and this legal entity's promotion or project will be described.
1.6. Personal data - any information relating to a natural or legal person - a data subject whose identity is known or can be established directly or indirectly by means of data such as a personal code, one or more personal, physical, physiological, economic, cultural or social characteristics.
1.7. Privacy Policy - A document approved by the Seller that sets out the basic rules for the collection, storage, processing and storage of Personal Data through easygetwarm.com. easygetwarm.com undertakes to protect this data and not to pass it on to third parties.
1.8 Seller's partner - a legal entity: 1) selling goods or providing services to easygetwarm.com, as well as a legal entity used to fulfill the Buyer's order; 2) the joint promotions or projects with which easygetwarm.com is carried out are published on the websites of this legal entity or in any media in which easygetwarm.com and this legal entity's promotion or project will be described.
2. GENERAL CONDITIONS
2.1. The Buyer confirms that he is familiar with the Procurement Rules by ticking the box "I agree with the Procurement Rules". The Purchase Rules approved in this way are a legal document binding on the Parties, which sets out the rights and obligations of the Buyer and the Seller, the conditions of purchase and payment for goods, delivery and return procedures, liability of the parties and other conditions related to purchase - sale easygetwarm.com. The buyer is not given the opportunity to place an order for goods on easygetwarm.com until he confirms that he is familiar with the easygetwarm.com Purchase Rules.
2.2. Only Buyers as defined in Clause 1.3 of the Purchase Rules have the right to purchase from easygetwarm.com. By approving the Terms of Purchase, the Buyer confirms that he has the right to purchase goods from easygetwarm.com.
2.3. If necessary or in the circumstances provided for in the legal acts of the Republic of Lithuania, the Seller has the right to change, amend or supplement the Rules. In order to ensure that the Buyers are acquainted with any changes to the Rules, a link to the new version of the Rules will be sent to the Buyers' e-mail addresses provided by the Seller. The new version of the Rules will take effect upon publication on easygetwarm.com.
2.4. Buyer agrees that his name, email address, telephone number, IP address easygetwarm.com will be processed for performance analysis purposes.
2.5. The Seller confirms that the Personal Data provided by the Buyer will be processed only in order to properly provide the Buyers with the services provided by easygetwarm.com (including the right to participate in promotions, projects). The Seller also confirms that the Personal Data provided by the Buyer will be processed for the purposes of analysis of the Seller's activities and Direct Marketing, if the Buyer gives such consent.
2.6. If the Seller has the right or obligation to provide the Buyer with information or documents by e-mail, in all cases the Buyer is responsible for providing the Seller with a valid e-mail address belonging to the Buyer.
3. PRIVACY POLICY
3.1 When ordering goods from easygetwarm.com, the Buyer must indicate in the relevant information fields provided by the Seller his personal data necessary for the proper execution of the order: name, surname, delivery address, telephone number and e-mail address.
3.2 By approving these Rules, the Buyer agrees that his personal data referred to in Clause 3.1 will be processed for the purpose of selling the goods and services to the Seller easygetwarm.com, and agrees to send to the e-mail address and / or telephone number specified by him to fulfill the order of goods.
3.3 easygetwarm.com confirms that such data will only be used for the purpose of ordering and delivering goods. easygetwarm.com undertakes not to disclose such information to third parties, except for easygetwarm.com partners who provide delivery of goods or other services related to the submission or fulfillment of the Buyer's order. Any personal data of the Buyer may be disclosed to third parties only in the cases provided for in the legal acts of the Republic of Lithuania.
3.4 By ordering goods from easygetwarm.com, the buyer undertakes to protect and not disclose his login details to anyone. At the same time, the Buyer confirms that he has the right to order goods from easygetwarm.com and complies with 1.3. point criteria. In the event that Buyer discloses its login details, easygetwarm.com shall disclaim any liability in connection therewith.
Upon completion of the work, the Buyer must log out of the easygetwarm.com system to ensure that no one will access his data, especially in cases where the Buyer uses a public computer (eg at a university, Internet cafes, etc.). easygetwarm.com does not accept any liability in this regard if the Buyer does not disconnect from the easygetwarm.com system upon completion of the work.
3.5 By submitting his personal data to easygetwarm.com, the Buyer agrees to receive informational messages from easygetwarm.com at the email address provided. easygetwarm.com undertakes to enable the Buyer to refuse to receive these notifications at any time.
4. ORDER SUBMISSION PROCEDURE AND CONDITIONS, TORQUE OF BUYING-SELLING LEGAL RELATIONSHIP
4.1 The buyer, by visiting the easygetwarm.com website, selects the goods he likes. Based on his choice, a shopping cart is formed.
4.2 After creating the shopping cart, the Buyer must enter the data necessary for delivery of the selected goods (see point 3.1): his name, surname, address to which the goods will be delivered, telephone number, e-mail and additional information that may be relevant when delivering the ordered goods. . Delivery terms and conditions are specified in clause 7.6.
4.3 Before confirming the order, the Buyer must make sure that the data provided is correct and in accordance with his wishes. The Buyer may also adjust the personal data necessary for the delivery of the goods after placing the order. The Buyer can only confirm the order if he states that he is familiar with and agrees with the easygetwarm.com Purchase Rules.
4.4 Once the buyer has confirmed the order, it will be sent to easygetwarm.com. The order is considered submitted from the moment it is received by easygetwarm.com. At the same time, it is considered that a purchase agreement has been concluded between the Buyer and easygetwarm.com. However, such an agreement is considered enforceable only from the moment easygetwarm.com receives confirmation from the bank about the payment for the ordered goods.
4.5 The moment of notification of easygetwarm.com about the receipt of payment shall be considered the moment of execution of the purchase and sale agreement between the Buyer and easygetwarm.com.
5. TERMS OF PAYMENT
5.1 The Seller starts to execute the order of goods only after the Buyer pays for the goods and the chosen method of their delivery. If the Buyer indicates that the goods will be picked up in the physical store of UAB Ortopedijos centras (see item 7.6.8), no delivery fee is required. Payment is considered made when the full amount due is received and credited to the Seller's bank account.
5.2 Prices on easygetwarm.com and in the order are quoted in Euros with VAT. The price of the product is indicated without delivery fee.
5.3 You can pay for the ordered goods:
- Electronic banking system Paysera.
5.4 The buyer undertakes to pay for the ordered goods immediately. Otherwise, he loses the right to make claims for violation of the terms of delivery of goods, because according to the Buyer's order, the shipment of goods begins to be formed only after easygetwarm.com has received payment for the goods.
6. WARRANTY OBLIGATIONS
6.1 easygetwarm.com sells goods that meet the conditions specified in the order. In cases when the goods delivered to the Buyer do not meet certain order requirements, the Buyer agrees first of all during the working day from 9 am. until 6 p.m. notify us by phone +370 602 92009 or e-mail info@easygetwarm.com, and easygetwarm.com undertakes to take all necessary steps to remedy existing deficiencies if such deficiencies are due to easygetwarm.com or third parties acting on its behalf. easygetwarm.com eliminates the defects within 3 working days, and if they are not eliminated, the Buyer has the right to defend his rights in accordance with the procedure provided for in the Civil Code of the Republic of Lithuania.
6.2 easygetwarm.com's obligations in relation to the goods:
6.2.1 In cases where a certain expiration date is set for specific goods, easygetwarm.com undertakes to sell such goods to the Buyer in such a way that he has a real opportunity to use the goods until the expiration date.
6.2.2 easygetwarm.com undertakes to deliver the goods of the appropriate quality and in accordance with the requirements of the order.
6.2.3 easygetwarm.com undertakes to provide the Buyer with the quantity and range of goods specified in the order.
6.2.4 In cases where the order includes a specific set of goods, easygetwarm.com undertakes to provide all items included in the set of items.
6.2.5 The goods are delivered packaged according to their nature in order to make the goods fit for their intended use.
7. DELIVERY
7.1 The goods are delivered throughout the territory of Lithuania.
7.2 The Seller undertakes to deliver the goods to the Buyer in accordance with the terms specified in the descriptions of the goods. These terms do not apply in cases when the required goods are not in the Seller's warehouse and the Buyer is informed about the lack of the ordered goods by e-mail. by mail. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the delivery of goods.
7.3 In all cases, the Seller is released from liability for violation of the terms of delivery of goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Buyer's control.
7.4 At the time of delivery of the Goods, the Buyer must together with the Seller or his authorized representative check the condition of the consignment. If the Buyer signs the invoice (bill of lading) or other document of delivery-acceptance of the consignment, it is considered that the consignment has been delivered in proper condition. If the Buyer notices that the packaging of the delivered consignment is damaged (wrinkled, wet or otherwise externally damaged), the Buyer must mark it on the invoice (bill of lading) or other consignment delivery-acceptance document in the presence of the Seller or his representative and write a free-form consignment violation report. If the Buyer fails to perform these actions, the Seller is released from liability against the Buyer for damage to the goods, if such damage was caused by packaging damage, which the Buyer did not mark in accordance with the above procedure.
7.5 Products ordered from easygetwarm.com, delivered in Lithuania:
7.6.1 Courier via VENIPAK
Price: delivery via VENIPAK couriers costs 5.00 Eur. Delivery to the Curonian Spit delivery costs 40.00 Eur.
Duration: ordered and paid goods are delivered within 1 - 5d.d. Venipak will inform the Buyer about the estimated delivery time at the Buyer's telephone number.
Place: Delivered directly to the address specified by the Buyer on working days from 8 am to 6 pm.
Delivery terms are agreed with the Buyer individually in the following cases:
• If the product is of non-standard size or weight exceeding 10 kg,
• If the goods are sent abroad
• You need to receive the shipment extremely quickly
Prices for additional services:
Waiting for the courier due to the fault of the Buyer when picking up or delivering the shipment is calculated 10 minutes after the courier arrives at the Buyer. Each hour spent by the courier is charged 20 Eur / hour (0.3 Eur / minute).
Heavier than 30 kg. manual delivery of consignments +0.03 Eur / 1kg.
7.5.2 Delivery to Venipak Pick-up Points
Price: delivery to Venipak Pick-up points costs 3.00 Eur. The shipping price to the Curonian Spit is coordinated individually.
Duration: ordered and paid goods are delivered within 1 - 5 days.
Location: The order is delivered to the selected Venipak Pick-up Point. The recipient is informed about the delivered order to the pick-up point by a short sms message to the phone number specified. Shipments are stored at the specified Pick-up point for 7 calendar days.
7.5.3 Delivery to Omniva ATMs
Price: delivery to Omniva post offices costs 3.00 Eur. The shipping price to the Curonian Spit is coordinated individually.
Duration: ordered and paid goods are delivered within 1 - 5 days.
Location: The order is delivered to the selected Omniva ATM. The recipient is informed about the delivered order by a short text message to the phone number indicated. Shipments are stored at the specified post office for 7 calendar days.
7.5.4 Shipping is FREE when buying for more than 100 euros.

8. PROCEDURE FOR RETURN AND EXCHANGE OF GOODS
8.1 easygetwarm.com states, and the Buyer confirms that he is aware that the goods displayed on the website in their color, shape or other parameters may not correspond to the actual size, shape and color of the goods due to the characteristics of the monitor used.
8.2 Return of Goods of appropriate quality is possible only in accordance with the Government of the Republic of Lithuania Resolution No. 697 in accordance with the approved Retail Rules. In this case, the cost of returning the goods is paid by the Buyer.
8.3 In the event that the reason for returning the goods is of poor quality, we undertake to replace the goods of poor quality with goods of suitable quality or to return the money paid for the goods at our own expense. Goods of unsatisfactory quality are replaced or returned in accordance with Government Resolution No. 697 approved Retail Rules.
8.4 High quality merino wool clothing, wool cannot be returned.
8.5 Goods purchased by easygetwarm.com may be returned by the Buyer within 14 working days of receipt of the goods (i.e. by signing the receipt document). Delivery costs are non-refundable. The cost of returning the product is paid by the Buyer.
8.6 When returning the goods, the Buyer must indicate the sender's address and pack the goods properly so that they are not damaged during shipment. The seller will not refund money for goods that were damaged at the time of shipment. The seller is not responsible for parcels that have been shipped improperly packaged with incorrect address, as well as if the parcels were lost or damaged during shipment.
8.7 Replacement and return of goods is possible only when goods are exchanged or returned:
8.7.1 were not used. The product must not be worn or otherwise used, it must be undamaged.
8.7.2 intact performance of the goods. The product must be presented in the original manufacturer's packaging and without losing its commercial appearance (the product must remain with all authentic labels). Changes to the packaging necessary for the inspection of the goods shall not be considered as loss of appearance.
8.7.3 if the goods consist of several parts, the original equipment must be retained upon return.
8.8 When returning the goods, the Buyer must in all cases provide easygetwarm.com purchase documents: VAT invoice / purchase receipt.
8.9 When changing the goods, a difference in prices arises, the Buyer must pay the Seller according to the recalculated prices.
8.10 Items are returned by filling in the prescribed form, contact info@easygetwarm.com for receipt.
8.11 The amount paid shall be refunded to the Buyer, excluding the price for delivery. Delivery costs are non-refundable.
8.12 Goods may be returned only if they meet the requirements set forth in Clause 8.6 of these Rules. The amount paid shall be refunded no later than within 14 (fourteen) calendar days from the signing of the return form and receipt of the goods purchased and returned by easygetwarm.com. By approving these Purchase Rules, the Buyer agrees that the money will be returned to the Buyer's bank account from which payment for the goods was made.
8.13 Special conditions apply to the return of goods during promotions and sales. These terms and conditions are published during each promotion.
9. EXCHANGE AND RETURN OF GOODS ON DELIVERY OF OTHER GOODS
9.1. If the wrong goods have been delivered to the Buyer, the Buyer must immediately, but not later than within 7 (seven) working days, inform the Seller by e-mail. email info@easygetwarm.com or call +37060292009. The seller undertakes to pick up such goods at his own expense and replace them with suitable goods. In case the Seller does not have the ordered goods, he returns the money paid for the goods to the Buyer. The money shall be returned to the Buyer within 14 (fourteen) calendar days after the Seller has received the Buyer's notice of withdrawal from the contract, and if the Goods are not returned to the Seller, the term provided for in this clause shall be calculated from the date of return. By approving these Rules, the Buyer agrees that the money will be returned to the Buyer's bank account, unless otherwise agreed between the Buyer and the Seller.
10. BUYER'S RIGHTS
10.1. The Buyer has the right to purchase goods from easygetwarm.com in accordance with these Rules.
10.2. The Buyer has the right to cancel the order in accordance with the procedure established by these Rules.
10.3. The Buyer has the right to withdraw from the contract in accordance with the procedure established by these Rules.
10.4. The Buyer has the right to replace or return only low-quality goods purchased in accordance with the Rules.
10.5. The Buyer has other rights enshrined in these Rules, the Privacy Policy and the legal acts of the Republic of Lithuania.
11. OBLIGATIONS OF THE BUYER
11.1. By using easygetwarm.com, the Buyer must fulfill his obligations, comply with these Rules, the Privacy Policy, other conditions expressly stated in easygetwarm.com, and not violate the legal acts of the Republic of Lithuania.
11.2. The Buyer must pay for the ordered goods or services and accept them in accordance with the procedure established by these Rules. If the Buyer chooses to pick up the goods at the Goods Collection Center, the Buyer must pick them up at the selected Goods Collection Center within the terms specified in the Rules.
12. RIGHTS OF THE SELLER
12.1. Seller reserves the right to change, suspend or terminate all or part of the easygetwarm.com features, as well as to change the layout of items on easygetwarm.com.
12.2. Seller has the right to suspend or terminate easygetwarm.com. In this case, all accepted and confirmed Buyers' orders are terminated and new orders are not accepted.
12.3. If Buyer attempts to compromise the stability, security or default of easygetwarm.com, Seller shall have the right to immediately and without prior notice restrict or suspend Buyer's access to easygetwarm.com or, in exceptional cases, terminate Buyer's Account.
12.5. The Seller has the right to cancel his order without prior notice to the Buyer, if the Buyer, having chosen the payment method provided for in Clause 6.3 of the Rules, does not pay for the goods within 1 (one) business day.
12.6. When the Buyer chooses the payment method provided for in Clause 6.3 of the Rules, the Seller has the right to contact the Buyer with the details specified in the order in case of uncertainties regarding the information provided in the order. In this case, the term of delivery of the goods starts from the day of contact with the Buyer. The Seller has the right to cancel his order without prior notice to the Buyer, i) if the Seller fails to contact the Buyer within 2 (two) working days after placing the order, or ii) if the Buyer does not provide the Seller with the requested information within the deadline specified by the Seller
12.7. The Seller has other rights set forth in these Rules, the Privacy Policy, other easygetwarm.com documents and the legal acts of the Republic of Lithuania.
13. SELLER'S OBLIGATIONS
13.1. The Seller undertakes to make available to the Buyer the services provided by easygetwarm.com under the conditions set forth in these Rules and other easygetwarm.com documents.
13.2. The Seller undertakes to clearly and intelligibly provide easygetwarm.com with the information provided to the Buyer in Article 6.2287 of the Civil Code of the Republic of Lithuania.
13.3. The Seller undertakes to respect the privacy of the Buyer. To process the Buyer's Personal Data only in accordance with the Rules, the Privacy Policy and the legal acts of the Republic of Lithuania.
13.5. Under the conditions provided for in the Rules, the Seller undertakes to deliver the goods ordered by the Buyer and to accept the goods returned by the Buyer.
13.6. If the Seller is unable to deliver the ordered product to the Buyer due to important circumstances, he undertakes to offer the Buyer a product analogous or as similar as possible in its characteristics. If the Buyer refuses to accept the product, which was offered as analogous or similar, the Seller undertakes to return the money paid to the Buyer within 14 (fourteen) working days, if a prepayment has been made, and in all cases to cancel the order.
13.7. The Seller, disagreeing with the Buyer's requirements, must provide the consumer with a detailed reasoned written answer no later than within 10 (ten) calendar days from the date of receipt of the Buyer's request, unless otherwise provided by the legislation of the Republic of Lithuania and the European Union.
13.8. The Seller undertakes to perform other obligations imposed on the Seller by the Rules, the Privacy Policy and the legal acts of the Republic of Lithuania.
14. RIGHT TO WITHDRAW THE PURCHASE-SALE AGREEMENT
14.1. The right to withdraw from the contract of sale
14.1.1. The Buyer has the right to withdraw from the contract of sale of goods within 14 (fourteen) days without giving a reason by notifying the Seller thereof. The Buyer may not exercise this right by concluding one of the agreements listed in Paragraph 2 of Article 6.22810 of the Civil Code of the Republic of Lithuania.
14.1.2. The Buyer shall notify the Seller of the withdrawal from the contract of sale in one of the following ways: by filling in a model withdrawal form or by submitting a clear statement setting out his decision to withdraw from the contract. Notice of withdrawal is sent by e-mail. email info@easygetwarm.com. Upon receipt of the Buyer's notice, the Seller shall immediately send an acknowledgment of receipt of the notice.
14.1.3. The term of 14 (fourteen) days provided for to exercise the right of withdrawal from the sales contract is calculated as follows: a. when a sales contract is concluded, from the day when the Buyer or a person specified by him, except for the carrier, receives the ordered goods; b. if the Buyer has ordered more than one product in one order and the goods are delivered separately, - from the day when the Buyer or a person specified by him, except for the carrier, receives the last product; c. if the goods are delivered in different lots or parts, from the day when the Buyer or a person specified by him, except for the carrier, receives the last lot or part; d. if a contract is concluded for the regular delivery of goods within a specified period, from the date on which the Buyer or a person specified by him, other than the carrier, receives the first goods.
14.1.4. If the Buyer has refused the purchase and sale agreement before the goods have been delivered to him, the Seller shall formalize such refusal of the Buyer as a rejection of the order and accordingly inform the Buyer thereof at the e-mail address specified by him.
14.1.5. If the Buyer has withdrawn from the sales contract after the goods have already been delivered or has withdrawn it, the provisions provided for in Clause 15 of the Rules shall apply.
14.2. The seller has an additional money back guarantee
14.2.1. After 14 (fourteen), but not 30 (thirty) days from the date of delivery or collection, the Buyer has the right to use the additional money back guarantee provided by the Seller to the Buyer, if all returned goods are with authentic labels, protective bags and original packaging, one-time the packaging is not damaged, ie the goods have not lost their appearance as sold.
14.2.2. The Buyer must notify of the intention to use this guarantee within 30 (thirty) calendar days from the date of delivery of the goods to the Buyer. The message is sent by e-mail. email info@easygetwarm.com, the notice must indicate the returned goods.
14.2.3. If the notification is made within 14 (fourteen) calendar days from the day of delivery of the goods to the Buyer, the provisions of Clause 13.1 of the Rules shall apply.
14.2.4. If the notice is given after the expiry of the period of 14 (fourteen) calendar days, but not later than within 30 (thirty) calendar days from the date of delivery of the goods to the Buyer, the Buyer shall bear all costs and risks related to the return of the goods. In all cases, the product must be returned to easygetwarm.com before the end of the 30 (thirty) calendar day period from the date of delivery or collection of the product.
14.2.5. The seller's additional money back guarantee cannot be used if the following items are ordered:
14.2.5.1. gift cards;
14.2.5.2. packaged goods which have been unpacked after delivery and which are unsuitable for return for health or hygiene reasons;
14.2.5.3. goods which have been manufactured according to the individual order of the Buyer or are obviously adapted to it, or which, due to their nature, can no longer be returned to the Buyer due to the loss (loss) of commercial properties.
15. Final provisions
15.1 The Agreement is concluded, executed and all communication between the Buyer and easygetwarm.com is in the official language.
15.2 Entity resolving consumer disputes out of court: State Consumer Rights Protection Service, address Vilniaus str. 25, 01402 Vilnius, www.vvtat.lt
15.3 All disputes arising out of or in connection with the purchase and sale agreement between the Buyer and the Seller shall be resolved through negotiations. If no agreement is reached, disagreements shall be resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
